5. PRELIMINARY SALE OR COMPROMISE

The Preliminary Agreement, or Compromise, is a deed by which both parties promise to complete a future Notarial Deed, within which they are reported all the conditions set out in the Purchase Proposal. The details of the parts, the characteristics and cadastral data of the property, the cost, the payment methods and, finally, the date of signing of the deed with relative delivery of the property will be explained in the preliminary draft. At the time of signing the Compromesso, an additional deposit, to reach at least 30% of the property price, must be paid by the buyer. It is important to know that once the Preliminary Agreement is signed, if the purchasing party changes their mind and no longer wants to proceed with the purchase, they will lose the entire Confirmatory Deposit, ie the deposit paid. If, on the other hand, it is the selling party who no longer wants to proceed with the sale, he will have to pay the buyer double the deposit paid up to then.

6. THE DEED

The Deed is an Official Deed drawn up by a notary chosen and paid for by the buyer; the notary, after having carried out all the necessary checks, must read and explain the contents of the Act at the time of stipulation. At the deed, the selling party is given the sum of money in settlement of the agreed price and, at the same time, the selling party will have to deliver the keys of the property to the buyer. If this exchange is not simultaneous, the delivery date of the premises will be specified in the deed.

Among the documents to be delivered in case of deed with natural persons we will have: identity document, tax code, birth certificate, marriage extract (for married couples or separated), certificate of free or widowhood status, separation or divorce decree, copy of the act of separation of assets or of the patrimonial fund (for married couples), authentic copy of the power of attorney (in the case of the intervention of a prosecutor), judicial authorization (for representation of incapable persons), residence permit (for non-EU citizens).
